These are the ground rules for fishing with Reel Rich Fishing LLC ("I," "me," "us"). Please read them. One person, the Group Lead, accepts for everyone on the trip.
Part 1: Terms
1. Who you're fishing with. Reel Rich Fishing LLC, run by Capt Richard Damianos, USCG-licensed Master and Florida Friendly certified fishing guide, Punta Gorda, Florida. Trips depart from the marina at 3192 Matecumbe Key Rd.
2. Booking and payment. Nothing is due at booking. The card you give at booking only holds your reservation. By booking, you give your express consent to Reel Rich Fishing LLC storing your card with Stripe and charging it, without further action from you, for the late-cancellation or no-show fee under the Cancellation & Weather Policy. The amount is the full trip price shown at booking, and this is disclosed to you before you book. The card is stored by Stripe; I never see your full card number. You can contact me at any time to revoke this authorization. Pay when your trip is over. Listed prices are the card price. We take cash or any major card, and cash gets 3% off. We don't take checks. See the Deposits & Payment Policy.
3. Cancellations, late arrival, and weather. You can cancel for free up to 7 days before your trip, including tarpon trips, through your booking confirmation or our website. After that, the free cancellation option is no longer available. To cancel after the cutoff, text, leave a voicemail, or email me. The full trip price will be charged to the card you gave at booking. If you don't show up, the full trip price will be charged. I wait 1 hour for late guests; after that it counts as a no-show. If I cancel for weather, we rebook or you aren't charged. Your choice. If I recommend not going and you insist on trying, and we have to return for weather, you pay the full trip price. If I decide to go and then have to cut the trip short for weather, the charge is pro-rated by the hour (trip price divided by trip hours), rounded up to the next full hour. See the Cancellation & Weather Policy.
4. Changes to your booking. There are no modifications to bookings online. To change your booking, contact me directly by phone at 941-621-9996, by text at 607-327-0221, or by email at CaptRich@ReelRichFishing.com.
5. Passengers. Inshore trips carry up to 5 anglers. Kids count toward the passenger limit. Kids 8 and under ride free as the add-on passenger in a package. Please tell me ages when you book so I have the right life jackets. Children under 6 wear a life jacket the whole time they're aboard. Adults must supervise their children at all times.
6. Safety. I'm the captain, and my decisions on safety are final. That includes when to go, where to fish, when to come back, and whether to cut a trip short. Please follow my instructions, wear life jackets when I ask, stay seated while the boat is moving, and handle hooks, knives, and rods with care. No illegal drugs, and no one may arrive intoxicated or drunk. I can refuse to take anyone out who is under the influence. All passengers must stay in the boat at all times. No jumping or swimming in the water for fish, dolphins, or to cool off. It is unsafe (boat traffic, sharks, stingrays, currents, hooks, and the prop). If your group wants to swim, I can take you to a designated swimming area. I can end a trip, without refund, if someone's behavior puts anyone at risk.
7. Fishing and fish handling. Redfish, snook, and tarpon are catch-and-release. Other fish can be filleted and bagged, subject to season, size, personal, and boat limits under Florida law. I follow all Florida and federal fishing rules, and I decide what can be kept. Fishing is never guaranteed, and I can't promise any number or type of fish.
8. What's included. Rods, reels, tackle, bait, ice, water, and your fishing license. Bring sunscreen, a hat, polarized sunglasses, and snacks and drinks (cans only, no glass).
9. Damage. You're responsible for damage to the boat or equipment caused by you or your group beyond normal use.
10. Photos. I may share photos of your trip on my website or social media. Tell me if you'd rather I didn't.
11. Changes and governing law. I may update these terms; the terms in effect when you book apply to your trip. These terms are governed by the laws of the State of Florida.
Part 2: Assumption of Risk and Release of Liability
Please read carefully. This affects your legal rights, including your right to sue.
A. Who this covers. This waiver covers every person on my trip, including the Group Lead, all adult passengers, and all minors in the group (together, "Passengers"). The Group Lead signs for themself and, as a parent or legal guardian where applicable, for any minor in the group.
B. Assumption of risk. I understand that fishing and boating are activities with real risks, including: weather changes, lightning, rough water, wakes and other vessels; slippery or moving decks; falls and falling overboard; sharp hooks, knives, rods, and lures; fish and marine life (including stingrays, jellyfish, and sharks); sun, heat, and dehydration; drowning; and other hazards, some of which cannot be foreseen. These risks exist even when everyone is careful and the captain uses reasonable care. I voluntarily accept these risks, known and unknown, for myself and the other Passengers.
C. Release and waiver. To the fullest extent allowed by Florida law, I, for myself and the other Passengers (and their heirs, personal representatives, and anyone claiming through them), release and give up all claims against Reel Rich Fishing LLC, Capt Richard Damianos, and their members, employees, mates, agents, and insurers ("Released Parties") for injury, illness, death, or loss of or damage to property arising from the trip, including claims based on the ordinary negligence of the Released Parties. This release does not apply to gross negligence or intentional misconduct, or to anything the law does not allow to be released.
D. Indemnity. I agree that if a Passenger in my group brings a claim that has been released here, I will be responsible for the Released Parties' reasonable costs of defending against it, to the extent Florida law allows.
E. Safety rules. I agree that all Passengers will follow the captain's instructions, wear a life jacket when told, and not use illegal drugs or be intoxicated or drunk, and stay in the boat at all times, with no jumping or swimming off the boat except at a designated swimming area where the captain says it is safe. Children under 6 wear a life jacket the whole time aboard. I understand the captain may end the trip for safety or for unsafe behavior.
F. Health. Each Passenger is responsible for their own health and fitness for the trip, including seasickness, medical conditions, medications, and pregnancy. I will tell the captain about anything he should know before we leave the dock.
G. Medical help. I allow emergency medical care if needed, and I accept responsibility for its cost.
H. Shared with all Passengers. I confirm that I have shared this Terms & Liability Waiver with every Passenger in my group (and the parents or guardians of any minors), and that they understand and agree to it. I am at least 18 years old and have authority to accept on behalf of the group. A paper copy of this waiver is also signed at boarding, and a minor's parent or guardian signs the paper form at boarding.
I. If part is invalid. If a court finds any part of this waiver unenforceable, the rest stays in effect. This waiver is governed by Florida law.
